[Erotic literature/fanfiction] Into the Omegaverse: a tale of lawsuits, author slapfights and kinky wolf sex

TLDR: kinky wolf sex stories lead to DMCA takedowns, lawsuits, author slapfights and a discussion about whether or not it’s possible to copyright an entire genre

TLDR not detailed enough for you? Just read the bold text

(WOW this turned out a lot longer than I expected it to)
Full disclosure: I don't follow erotic literature, and Omegaverse fanfiction isn't really my scene. I'm gonna own up to the fact that I haven't been keeping up with it, and that I was only tangentially following the drama.
Fanfiction is hobby that doesn't need explaining. Anyone who's ever been active in fandom knows how it works - you write a story using the setting of another piece of media
Over the years, fanfic writers and readers have created their very own subgenres, tropes and settings. Didn't like how the new Star Wars trilogy went? Fix-it fics. Wish that John and Sherlock became a couple? Shipping fics. Ever wondered what it would be like if Hogwarts was a Starbucks and the students were underpaid millennial baristas instead of wizards? Coffee shop AU.
Today, we're focusing on one in particular: Omegaverse/ABO.
Specifically, we're going to ask what happens when fanfiction authors become published authors and bring fanfiction tropes with them.
Let's find out.

Content warning: while the drama itself is SFW, there are some, shall we say, risque excerpts and quotes embedded throughout the write-up. Omegaverse/ABO as a subgenre can also be a little wonky with consent, so if that's something that makes you uncomfortable, tread with caution.**

A, B... oh? What the heck is the Omegaverse, anyway?

(If you already know how Omegaverse works or just want to hear about the drama, feel free to skip this bit)
The year is 2010. Willow Smith is whipping her hair, people are debating the ending of Inception and Spain has just beaten the Netherlands 1-0 to win the World Cup.
It's also also the year that sees the creation of a whole subgenre of erotic fanfiction known as the Omegaverse or ABO. This basically it takes the wolf theme and runs with it by applying wolf behaviours (but just the hot, sexy ones, y'see) to human characters.
In this setting, characters are born into one of 3 biological categories based on wolf power dynamics:
(NOTE: Alpha/Beta/Omega status isn't determined by biological sex - male omegas can become pregnant, and female alphas can get someone else pregnant. The exact mechanics vary depending on the author)
So the premise of an Omegaverse/ABO story might look a little bit like this:
"First, A stole B's girl. Then B got back at A by totaling his car. They've been at each other's throats ever since. So when B feels himself going into heat, he must do everything he can to resist the overpowering biological urge to surrender himself to the nearest alpha: his oldest rival, A"
You get the idea.
Omegaverse/ABO is a subgenre and like all genres, it comes with a series of common tropes and conventions that are shared by most, if not all Omegaverse stories. Just like sci-fi stories often share elements like spaceships and aliens, most Omegaverse stories share tropes including:
While there are some who call the entire setup problematic for a whole bunch of reasons (some think it's rapey, others that it's inherently toxic, I've heard some people here-and-there call it transphobic), it's proven popular, with over 76,000 entries on AO3 alone, and it wasn't long until it made the jump to published fiction...

The alpha ...

What do 50 Shades of Grey, Mortal Instruments and Paradise Lost all have in common? They're all fanfics that later got turned into published (and highly-lucrative) novels.
And Addison Cain (not her real name) thought that her Omegaverse fanfic had what it took to join them. After all if Twilight BDSM could sell millions of copies, why couldn't kinky Batman wolf sex?
So she got to work, publishing Born to be Bound in 2016, an adapted version of one of her fanfics.
While Cain doesn't claim to have invented omegaverse, she does claim to be the originator for straight, heterosexual Omegaverse fiction.
You see, omegaverse/ABO - like much of the fanfiction scene - is dominated by writers creating content about same-sex pairings. For every Reylo or Zutara, you have half a dozen or more Destiels, Spirks, Catradoras, Korrasamis and Drarry's.
Long story short, omegaverse stories tend to be hella gay, so in that sense she is somewhat unique - even then however, it's still highly unlikely that there were absolutely zero straight omegaverse stories before Addison Cain came along.
Still, that's one of her claims to fame - that and the fact that she got published.
And as it turns out that Cain is an apt pen name, because like her biblical namesake, she's the jealous type.
Cain is active on social media and frequently shouts out other authors and promotes their work - however, she also has a protective streak over what's hers (or at least, what she sees as hers). Today's drama isn't even the first time it's come to the surface, either. [In 2016, she posted a looooooooong Facebook post in calling out The Dragon's Maiden (TDM), another omegaverse author and accusing TDM of plagiarism. Here are a couple of examples of what Cain claims TDM copied from her:
Cain TDM
There was nothing special about the fluid crusted, sticky arrangement she had woken up in. Everything on the bed, including the man and woman on it, was crusted with a mixture of bodily fluids, tinting the black bedding a sickly looking grey.
"You have a mate," he reminded her, releasing her wrist to brush the sore bite mark he'd left on her shoulder. "I claimed you. You belong to me now." "You are my mate. It is done."
Sharp teeth came to her shoulder, Shepherd's knot growing bulbous until the Alpha could no longer thrust and she could not squirm away. She screamed in pain and pleasure, sobbing as his teeth ripped into her skin, Shepherd growling long and low with her flesh torn from his bite. Without warning, his teeth clamped down on the sensitive flesh at the crook of her neck. He growled savagely in satisfaction when he felt his teeth pierce flesh and the exquisite taste of her blood flow into his mouth, over his tongue.
No, she wanted the thing that was supposed to happen. He was supposed to be fucking her. Why was he waiting? - Every part of her was screaming out that he should be stroking her and easing the need. THAT IT WAS HIS JOB! She was in heat. He was supposed to be fucking her! It was the natural order of the hierarchy. Why wasn't he?
As much as I'd love to keep pushing smut down your throat, I think you get the idea. Personally, I don't see enough to justify the P-word - there's only so many ways you can write a sex scene - but I suppose you can read through the post and see for yourself if you dare.
According to TDM, she received threats and harassment from Cain's fanbase, including a doxxing threat, and she was advised to remove the story for her own safety and file a police report.
To which Cain pretty much responded with:
People like this believe their own lies. Her story is being taken down for plagiarism plain and simple
And why not, let's throw some review manipulation onto the pile as well - after all, its not like the optics could get worse, right?

Dogfight

Of course, Cain wasn't the only one who tried their hand at publishing Omegaverse fiction. Zoey Ellis (not her real name either) is another author who gets her own Omegaverse book, Crave to Conquer published just 2 years after Cain's debut.
Ellis keeps a low profile and wasn't quite as public about the affair as Cain was, so it's a little hard to get a read on her. She barely mentions it on her blog, and either keeps things behind closed doors or she's scrubbed her Facebook and Twitter since then. While there isn't much I could find about Ellis online, all you need to know is that Crave to Conquer is a success, selling well until one day literally every single non-physical copy of Ellis' books taken down, including copies already downloaded to eReaders.
And that brings us to the drama.
Turns out, all of this buzz hadn't gone unnoticed by a certain already-established Omegaverse author. Upon hearing word that Ellis' story shared certain elements with her own, Cain and her publisher filed DMCA notices to iTunes, Google Play, Amazon and even Barnes & Noble, alleging that Ellis had - you guessed it - plagiarised Cain's work.
And claims weren't just filed for Crave to Conquer, but for some of Ellis' other works were also hit with DMCA notices, including a sequel that wasn't even out at the time.
Addison Cain defended herself on Facebook, claiming that the decision to file a DMCA takedown was on her publisher, and not her, and that she was innocent (which is a lie, but we'll get to that):
I stayed silent as Zoey Ellis accused me of blackmail, of slander, of harassment—without a shred of evidence.
...
My publisher filed DMCA notices listing examples of infringement to remove this person’s infringing works from publication. (emphasis mine)
...
Can you imagine, just for a moment, the horror of having to hire an attorney to defend yourself in an out of state lawsuit over DMCAs sent by your publisher?
...
It contained every horrible lie one could think of to say about me. There was just one problem—it didn’t prove any of the accusations against me. Nothing. Not a single Facebook post showing harassment. Not a single email threatening blackmail. Not a single statement from any author supposedly bullied by me. Nothing. Why? Because I have never harassed, threatened, or otherwise bullied anyone in any forum.
...
"My publishing house has chosen to take legal action against another author for plagiarism and copyright infringement of one of my books. They own the rights to print and distribute my story (...) this is out of my control." (This quote comes from court documents - more on that later)
Eventually, the takedowns were reversed, but not without consequences - not only had Ellis missed out on sales, but there was also the question of reputational damage. Just looking at the reviews on Goodreads and you don't have to look far to find your first 1-star review mentioning plagiarism.
Unlike The Dragon's Maiden however, Ellis decided she wasn't going to take this lying down. She and her publisher (who she may or may not own, it’s complicated) took action, filing two separate lawsuits, one against Cain and her publisher, and the second against Cain herself. Ellis sued for an injunction as well as damages, accusing Cain and her publisher of:
Here's a copy of the motion to file - remember, some poor paralegal had to write all of this, and some poor judge ahd to read it.

"No one owns a genre, least of all Omegaverse."

Let's get one thing out of the way: when you read about the Omegaverse lawsuits online, a lot of the discussion is about how Addison Cain is trying to copyright an entire subgenre. In her defense, she never says that and while she claims to be the inventor of hetero Omegaverse fiction, she doesn't claim to own it.
Of course, that didn't stop people from seeing it that way.
Fanfiction is a hobby that sits in a legal grey area. While most creators nowadays are pretty permissive when it comes to people creating fan work, it wasn't always that way. Back in the old days it wasn't unheard of for fan fiction authors to get cease-and-desist letters for their hobby, and many fanfiction writers had to share their stories through secret mailing lists.
The result? the fan fic community can be a little bit defensive over what they see as outside attempts to stifle their freedom to write.
So while Cain was claiming that the DMCA takedowns were because Ellis' book shared certain plot points, many in the community fired back by arguing that these were common Omegaverse tropes, that they were explainable by coincidence or by freaking out and claiming Cain was trying to copyright an entire subgenre of fiction (which to her credit, she wasn't).
Not only that, but as a setting that developed in fan spaces, a lot of fanfic authors felt ownership over it, and were mad at what they saw as an attempt by an individual to claim it as their own. Many supported Ellis even though the case didn't directly involve fanfiction, believing that a less permissive author would use the precedent to come after fan authors with DMCA strikes in the future. After all, it had happened before.
And finally, some simply saw it as an established author throwing their weight around to squash the competition, or thought the whole thing was ridiculous, and took to the internet to make their opinions clear:
Imagine getting jury duty, and it's the ABO lawsuit
...
Addison, the issue is that by claiming standard plot items that you must have KNOWN were standard as similarities, you did effectively assert claim to concepts like suppressants, heats, and ruts. What proof do you have that you were plagiarized beyond standard Omegaverse fare?
...
In the beginning, I was on Addison Cain's side. I initially swore off reading Zoey Ellis after reading AC's blog post. In fact, I put Crave to Conquer on my gonna pass shelf. After reading all the court documents, it's clear AC is not the victim in this narrative, and I'm saddened to see this kind of bullying from an author that I've enjoyed reading in the past.
...
You gonna try and trademark BLM too?
...
Ooooh this reminds me of when there was an author waaaaay back when ( like 1997 or so ) who claimed to have invented/come up with body swap fics ( like two characters accidentally switching bodies in a curse/spell/soulmates, whatever ) and was pulling something like this, she started in about lawyers and such but twitter and stuff didn’t exist then so I really don’t know what came of it. Honestly, I kind of believed her at the time because it was a long ass fic and hers was the first I ever read of the kind - fan fiction.net didn’t even exist when she wrote it so who knows?
Others came out in defense of Addison Cain:
Like I said, I'm not a lawyer. I have no idea if this much would satisfy the legal definition of plagiarism. I DO know that Addison's publisher felt confident enough to file DMCAs on her behalf. I DO know that these are an awful lot of coincidences and I'm not at all surprised that many readers contacted Addison after she was nice enough to recommend Ellis' book and they went and read it.
The story even got picked up by mainstream press and opinion pieces started flying about problems with the DMCA. One cheeky person even wrote a story of their own making fun of the whole situation (no ABO here though, just regular old sex).

The smoking gun

As part of the discovery stage of the legal proceedings, both Cain and her publisher were required to submit a range of documents as evidence including several pages worth of emails talking about Zoey Ellis and her book.
And hooboy were there were some real bombshells in there.
(I was able to find a copy of these exchanges, but real names are mixed in there so i won't link the doc itself, but it's pretty easy to find)
Remember how Cain was claiming that she was innocent, how she would never file a DMCA against another author and that it was her big, bad publisher that was taking matters into their own hands? Turns out, that was a lie:
Cain: "If Amazon, iTunes and B&N comply with the DMCA and a stink arises, I am prepared for the backlash (...) I will deflect to [publisher] and remain distant and naive."
...
Cain: "I will remain silent publicly, unless it gets to a point that a single, professional post on the topic (once again deflecting to the publisher) needs to be posted."
Cain: "Some people will be reactive right out of the gate, but that's why I have a publisher to hide behind. It will pass quickly. So long as I stay above the fray, we're all good."
...
Publisher: "Send her a letter demanding the removal of the books and the immediate access to all financial records since technically she owes you all of those royalties. It may be enough to scare her into doing it when she sees you are serious. We give her 72 hours to respond, and then if she doesn't we send a second letter from our attorney . Then we go to Amazon."
...
Cain: "Now that I've thought it over, both books should be taken down. She shouldn't profit off screwing me over."
...
Publisher: "Your decision to hide behind [publisher] and paint us as the instigators is how it absolutely should be. Let us take the heat. All you have to say is 'my publisher chose to take action. It was and continues to be out of my hands'. Let people get mad at us."
...
Cain: "I don't have a copyright filed for this, but [publisher], can you submit my contract as proof of first publishing and send in a DMCA to Amazon?"
In summary, despite claiming the moral high ground, Cain knew about the DMCAs and actively participated in brainstorming ways to shut down Ellis' writing.
Needless to say, these were pretty damning for their case, and bolstered Ellis' claims that she was being targeted. With few other options, Cain's publisher decided to settle the case and take the L.

Much ado about knotting

Unfortunately, that's where our legal drama comes to an end. Despite all of the bluster from both sides, the whole affair kind of, well, fizzled out anticlimactically.
2019
2020
And so our story comes to an end. Would Zoey Ellis have succeeded if her publisher hadn't gone under? Would this have led to all omegaverse fanfiction being scrubbed from the internet? We'll never know.
Two years of litigation later, and we're pretty much back where we started. Ellis' books were recognised as original works and are available for purchase once more, while Cain didn't have to pay out for either lawsuit and didn't suffer any direct consequences.
And for fanfic authors, none of the bigger legal issues were really settled. Fanfiction still occupies a legal grey area, and DMCA strikes are still incredibly easy to abuse, but writers are still going at it, with Omegaverse fics popping up all over the place.
Still, nobody's getting sued at the moment and everyone sortof got what they wanted. The end, right?

Epilogue: another storm on the horizon

Because lord knows we can't get a break, Cain filed a countersuit this year against Ellis for all the usual stuff: emotional distress, defamation, the works. It's still early days and as far as I know Ellis hasn't responded yet and seems to be keeping her head down, so watch this space.
And there's more drama brewing on the periphery too. A week ago, Broadway Musical enthusiast, YouTuber and published author Lindsay Ellis (no relation) put out a snarky, sardonic hour-long video going over the Omegaverse lawsuit in far greater depth than here (featuring guest appearances from LegalEagle, Contrapoints and pretty much all of breadtube).
The video has revived discussions about the omegaverse lawsuits and put Cain back int he spotlight. I seriously recommend watching it - not only is it a great watch, but there's also a chance it might not be up for much longer, since it also pretty much immediately triggered an email from Cain's lawyer

The end? Probably not for a long time yet

I was looking at Joe Biden’s official platform and cringed when I got to the “ending gun violence” section. This is just a sample of the terrible ideas his campaign is preaching.

THE YAKATRASH 141 WAS NOT THE PRECURSOR TO THE F-35 PLEASE STOP (effortpostish)

Here is a thread of retards, here is a second one.
Here are some notable dumb dumbs that must be bullied for their sins:
u/Garvit_Chaudhary
u/Hornful
st_paulus

Copy pasta i made a YEAR ago:

A lot of people out there like to say that the F-35Bs STOVL system (lift fan and swivel nozzle) is based on the YAK-141s STOVL system. Many also say that the partnership with LM and Yakovlev supports this claim. This claim is incorrect and everyone who claims this is bad and should feel bad. Here is why.
To start, the swivel nozzle originates from the Convair model 200 in the 1950s up the the early 60s.1 The 3 bearing swivel design was simply not created by Yakovlev, and thus not original. None of the dates match up either. The JSF program originates from the ASTOVL program that started around 1980, and:
"Between 1980 and 1987, NASA funded studies at all of the major aircraft companies to devise innovative concepts for a supersonic successor to the AV-8B Harrier, and the British Ministry of Defence conducted similar studies in the United Kingdom. Lockheed’s ASTOVL concept was based on the tandem fan engine advocated by Rolls-Royce [2,3]."
Keep in mind, the Yak-141 flew in 1987
The tandem fan engine is an early predecessor to the F-35Bs STOVL system. The concept dates back to 1984,4 and the filing date for the patent was very soon after the Yak-141 first flew.5,6 There are also all the patents filed for the swivel nozzle design which dont line up with the first flight of the Yak-141. Source 7 has a very, very early on design of the swivel nozzle, dated to 1956. Boeing made a design in 1963.8 In 1979 Boeing filed a patent for a type of swivel nozzle design, although with only one bearing. One of the most important examples was in 1970, where general electric filed a patent for a 3 bearing swivel nozzle with a gear system to change it between modes.10 In 1980 Rolls Royce filed a patent for some sort of turning nozzle.11 Lastly, in 1984 Rolls Royce filed a patent vectorable nozzle, very similar to the F-35s.12
Source 15 may also be related, dating back to 1986.
All this being said, the lift fan and swivel nozzle design was already almost completed by the time the Yak-141 flew. By the summer of 1987 Paul Bevilaqua was almost finished with the design, and finally completed it by connecting the engine to the lift fan. 2,3
So what about the lift fan being right behind the pilot? This was also apart of the design since the convair model 200, and were also present in the EWR VJ 101. It was also thought two main lift posts would be more stable than the harrier or boeing designs.
So what about that thing with Lockheed Martin and Yakovlev? As it turns out, in the summer of 1995, after all these designs existed, Yakovlev assisted Lockheed by giving design data. Source 13:
Lockheed Martin also turned to Russia for technical expertise, purchasing design data from Yakovlev; and used an 86 per cent subscale model (originally developed for the CALF project and fitted with a Pratt & Whitney F100-PW-220 engine plus an Allison shaft-driven lift fan) for testing.
While this was happening Rolls Royce bought the Allison Engine company, which had of course been testing the lift fan. All of this was happening at the same time.
Pictures dating back to 1983
http://www.aerospaceweb.org/aircraft/fightejsf/pics01.shtml
Note how Mcdonnel douglas had a similar design, but not a lift fan.
Here is this image translated:
https://upload.wikimedia.org/wikipedia/commons/thumb/1/16/Scheme_of_Yak-141_powerplant.png/2560px-Scheme_of_Yak-141_powerplant.png передний струйный руль is "front jet rudder"
подъёмные двигатели are "lifting engines"
then the "air transfer canal from the PMD to the PD (the lifting engines) and the front jet rudder"
pod'ëmno-marševyj dvigatel' appears to be a "lifting-sustaining engine"; that's the PMD
then on top you have the air transfer canal between the PMD and the jet rudders at the end of the wings
please note that the sources might be a bit fucked up.

PSA: Please Teach Your Puppy How to Relax

A few weeks ago, someone posted a thread asking what was the best thing we taught our pups to do. At the time, I said “back up”, which I still think is really useful for us. But right now, I’m sooo glad we’ve spent a lot of time teaching our puppy to relax. We live on the west coast of the US and while we’re luckily far from any actual fires, the air quality is poor from all the smoke so we can’t spend very much time outside. Our pup is a Mini American Shepherd; a small herding breed like an Aussie, if you’re unfamiliar. They’re known to be “high energy” and I often see suggestions on here and across the internet to physically exercise your dog until they're completely exhausted if they have excess energy. Run, fetch for hours, dog parks, doggy daycare. But, there are a few issues with that. First, these high arousal activities are introducing a ton of extra adrenaline into your pup, potentially putting them in a more excitable state than before. On top of that, this amount of exercise is not always possible (like now) and for us, it's not sustainable. Keeping your pup on an ever-increasing exercise regimen is just going to turn them into a super-athlete that needs enormous amounts of physical exercise every day. What will they do if you’re sick for a day? Or quarantined? Or can’t go out due to smoke?
Now, I’m definitely not saying you should never exercise your dog. It’s so important to make sure that they’re in good physical shape. But make sure to balance that physical exercise with mental stimulation and, just as importantly, rest! I’ve been reading about this concept a lot lately and have really found these articles to explain the concept of “overdoing it” with your dog very well:
Don't get too caught up in click-baity titles. They all basically come down to the same concept: we tend to over do it with our dogs and are potentially harming them in doing so. The concept of "enforced naps" is a big one in this sub-reddit since puppies sleep for 18-20 hours a day, but even adult dogs need to sleep and rest a lot. According to the AKC, "Dogs tend to spend as much as half of their days asleep, 30 percent awake but relaxing, and just 20 percent being active."
Here are the resources/activities I've found most helpful in teaching this super important skill:
Please feel free to add more resources on calmness or discuss here :)

My Nmom had Munchhausen by proxy when I was a child, and I just found the evidence.

Note: The word "retardation" is used in this post meaning the medical term only.
For a while I have had in possession an envelope marked "S. Divorced Medical Records." I stole it from my Ndad's place when I moved out and didn't get around to reading it all. I read the reports from my pediatrician starting at a young age, 6 I think? and that was it.
The end of June I finally went through the whole thing and everything at school made sense. Why I was treated so poorly, why all my teachers treated me like I was slow, why CPS were told I had Asperger's syndrome.
My Nmom told everyone I had it when I was never diagnosed.
So I got in touch with the administration at my old schools where I grew up and requested my records. All of them, all of my IEP records and evaluations starting from preschool. I got them all yesterday.
My Nmom had me psychologically evaluated early and made sure to bring it up early that my Ndad has a family history of depression and my Nmom's side had a family history of "being shy." If you ask me, what she meant by "being shy" was "a pattern of abuse to keep my child quiet." So I was seen as the shy kid for no reason from the beginning.
My IQ was tested when I was 7 and my IQ was Borderline at 78. So my Nmom had me extensively tested for mental retardation/disabilities. To her dissatisfaction, I was never diagnosed with a learning disability, ASD, or any type of mental retardation including Fragile X syndrome. She fought those answers and had me diagnosed with ADHD-PI (known back then as ADD) probably abusing me at home so I would show symptoms of it so she can get me medicated. And I was, I was on Adderall from 9-12 and Concerta at 13. Every year I was on Adderall, she had my dosage increased. From 10mg, to 15mg, to 20mg, all because she wanted a pill to make me do better in school, along with the constant bullying and abuse at home. Every time my Nmom brought me in complaining about the side effects, my dosage was increased. THE FUCK?
I had an IEP forever due to my speech. She wanted me tested for mental disabilities because I was born with a stutter and she could not for the life of her know why it never got better. Maybe it was because I spoke at 1,000WPM because every fucking time I tried to talk to her or in a group I was talked over and shushed and all I wanted was to GET MY FUCKING WORD IN. Ahem, suffice to say, after kindergarten the speech "therapy" was subpar, if anything. None of the "therapists" and "pathologists" I went to were of any help. They were so bad I don't even remember what we used to do during our "sessions." My earliest memory of school-provided "speech therapy" was one of my early sessions where the pathologist made us aware of the roof of our mouths. When school speech therapy wasn't working (hmmm I wonder why...) she forced an Anti-Stuttering Device on me, that also didn't work because I hated it. High school was when I didn't need the IEP because I wasn't even taking speech classes, she just wanted the IEP for control.
I was tested a bunch of times on my educational learning bullshit and math was ALWAYS my worst subject. Really, it was so bad that in school I would take a fractions test, score a 16, retake it, and score a 12. Instead of getting me a tutor, being HELPFUL at home, and taking an interest in my studies that wasn't screaming at me, I was medicated.
My Nmom wasted no time in taking control of my image and education the minute she was allowed. I was a disorganized mess who would finish homework in study hall and hand them in and my teachers would lose my work and tell my Nmom I never handed it in. She was quick to automatically blame me, and my teachers believed that if I found an assignment boring or too hard, I just don't do it. Which is fucking false. What I needed was HELP and I never got that at home, and the special ed teachers were baffled when I wouldn't specifically ask for help in class and waited for them to notice I was struggling. Nmom was right there to blame me. I didn't want to ask for help, I hated school, these assignments were boring, all I wanted to do was "waste time on the computer." No one ever asked "why" I didn't ask for help, because I would tell them I would ask for help at home and get screamed at.
When I was 13 or 14 I dosed off in English and got screamed at, everyone laughed. For some reason, Nmom thought that was a great time to take me off Concerta. I wasn't retested for my alleged ADD to see if it "went away," she just took me off the medication. Why? No idea, maybe me falling asleep in class made her look bad. She would take me to the school psychologist and complain about my "low self-esteem" which is a hallmark symptom of autism a result of autistic people who struggle with their symptoms, desperately trying to get me diagnosed with it. She wanted an autistic child so badly.
But it never happened because I was not nor ever was autistic. I had low self-esteem because my Nmom was my main bully and she allowed my Nbrother to call me "Sped" and the R word all the time. I was doing shitty in school EVERY YEAR because I had no help at home. I would go to my Nmom for homework help and she'd go "YOU were the one in school today so YOU know how to do it. Get off the damn computer and do your homework." I was still as lost as can be so I went to my Ndad for help, and he would open my book, see a subject, and explain to me the history of that subject for 2 HOURS and not help me at all with it. I would BEG him to PLEASE STAY ON TOPIC and he would promise, only to do it again, and would slam my book down and scream at me if I even dared to look bored when he went off topic.
Nothing stopped my Nmom. She couldn't get the diagnosis she desperately needed, so she went around telling everyone I had Asperger's Syndrome. She told my best friend's mom (my best friend told me), my teachers, my special ed teachers, the principal, etc. Everyone. She told CPS I had Asperger's so they would think I was making it all up, instead they blew my report out of proportion to the point where I stopped disclosing my molestation because I felt like every time I answered "No" they turned it around and went "she has Asperger's, she's scared, she really means Yes." (which is what my Nmom did all the time, ironically). She limited my social interactions, she abused me mentally, emotionally, and sexually, so I would be conditioned to never leave her. When I needed glasses, she made sure I got frames that made me look incredibly stupid to go along with the "disabled" look she wanted so it was more believable.
Here's the fucked up thing: I KNEW the entire time someone was telling my school I was slow, I was dumb, I was disabled. I knew it, I could feel it. I didn't understand why I was taken out of the classroom all the damn time to a "quiet room" to do tests. I had no problem with distractions. Hell, one time I was taken out of my science class to do a test, asked my teacher for help on a question, she told me to guess so I did and she said it was wrong and gave me the answer. I was like, "no, this isn't right" and walked back to class. I had to do a project in middle school for history and I did a massive paper and turned it in. My special ed teacher REFUSED to believe I did it and forced me to show her. She went, "Ok, good" and I demanded an apology and she refused. I knew the WHOLE TIME and I would complain about it constantly to my Nmom, who would shrug it off.
When I was 17 I made the CPS report and Asperger's was named and it all CLICKED. I screamed at my Nmom for telling everyone I had that. She came to me, knelt down to my level, and said, "you do not have Asperger's. I have never told anyone you had Asperger's." SHE FUCKING LIED TO MY FACE. SHE GASLIGHTED 17 YEARS OF THIS SHIT TO MY FACE!
17 years of being medicated for no reason, tested extensiely for a disability I never had. All so my Nmom could be blessed with an autistic child she can milk for sympathy. And I looked it up, having an autistic child means you are allowed to collect SSI/Disability. I knew she hated working so much. She hated working so much that she wanted an autistic child so she could comfortably collect Disability and not have to work. That's where the Munchhausen came in, and I knew it. I knew it.
I am an example of a child who was brutally failed by the system. If one person, one of those people enabling my Nmom by extensively testing me, ONE OF THEM, ever, asked about how my support is at home, this would've all been halted immediately and my Nmom would've been forced to stop testing me. Hell, I WOULD tell someone about the shit that went on at home and the only thing that happened was in Elementary School the principal called my Nmom and asked her if we had heat because I would complain about my room being freezing in the Winter. Nmom said yes, and then demanded I stop talking about home at school so she doesn't get called "so you won't get taken away." Me? HELL YEAH. TAKE ME AWAY. Middle school I began every conversation with "I fucking hate my mom," and no one, not a single soul, did a DAMN THING. Mandated Reporters my whole fucking ass.
And now this bitch has the audacity to come after me, desperate for a relationship, with the mentally disabled child she so desperately wanted. She can fuck RIGHT OFF. She REFUSES to leave me alone. 2 years ago she screamed in my face that I was unplanned. When I was born, a stuttering child, she went from seeing me as useless to being her meal ticket to getting free money and not having to work. Instead, she got me, a completely normal stuttering child that she hated. There is home video of me as a toddler trying to get her attention and her actively ignoring me. AND SHE WANTS TO BE IN MY LIFE NOW? GET OUT. ALL THE WAY OUT.
I THRIVED in college. No one to overbear me and constantly check my grades. I am insanely organized, I submit assignments on time. Yes, some assignments are hard as fuck, but do I ever shrug and go "don't wanna"? NO. NEVER HAVE. My last ever high school GPA when I had my IEP was 2.15. My college GPA so far is 3.2 AND I made the Dean's List in Spring 2016.
I got a feeling my Ndad was in on it, too. He just wanted a disabled child that he could keep at home and use as his live-in maid who cooked, cleaned, and listened to him bitch. And if I said anything that he didn't like, I was automatically brainwashed by someone else because I am too disabled to think for myself. He never actually gave a fuck about these tests, never went to any of them, but he was totally in on the "she's disabled" shit. Didn't stop his wife from abusing their daughter. He would yell at me that I lacked empathy, yet one of the evaluations said I empathized with my Nparents. Me? I think the repeated abuses in my life made me grow up to be very tolerant and apathetic towards them, effectively abusing the empathy away, which is exactly what he wanted. I was an empathic child but not an empathetic adult? Yeah, no, that doesn't happen on it's own. What's one of the main symptoms of Asperger's? A lack of cognitive empathy, but the kind of empathy he was telling me was affective empathy. He tried to project that onto me. Yeah. He was definitely compliant.
It was ALWAYS me who had the mental problems. Never anyone else. My Nbrother was (very rightfully) diagnosed with ADHD and attempted to be medicated. Nmom never forced Adderall down his throat, nope, just me. Because he was good at school. When the side effects got really bad for him? Immediately took him off. Kept me on it for 3 years and constantly complained about the side effects for me. Hell, Nmom mentioned my Nbrother's diagnosis early so I would get diagnosed quicker because I had a "family history" of it now. Man, she sure did play the system in her favor.
To this day I am still incredibly fucking angry at my previous school system. They had numerous opportunities to be worried about me including me coming to school crying and telling my teachers my Nmom CALLED ME UGLY. All they did was call her, she denied it and labeled me a liar, and nothing happened. The teacher she called even tried to tell me she didn't say that WHEN SHE FUCKING DID. I WAS THERE. IT'S BURNED INTO MY MEMORY. Gaslighted by her and the school. I am appalled.
To all of my siblings in this community who are teachers, please listen to the children. Parents will pull this shit, call their own kids liars, abuse their kids into symptoms so they can get diagnosed with something. It is never for the child's benefit. Nothing is beneficial about putting a child with normal mental functioning in special education classes and treating them the exact same way as the disabled children. If a parent seems particularly interested in their child's mental illness developmental disorder, pull the child aside and ask them about home. Watch their body language, their facial expression, signs of anxiety, they may even cry. If it's unusual that they are "fine" at home and particularly bad at school, they are NOT "fine" at home.
Thank you to everyone who read the whole thing. I don't expect anyone to have finished it. I'm still coming to terms with this myself. I appreciate support or similar stories if you have any. Also, do feel free to cross post if applicable.
EDIT: Changed some information thanks to AutistInPink's corrections. Thank you again!
EDIT 2: Holy cow I did not expect all the responses! Thank you all for reading and commenting, it melted my heart and I teared up a little! I did something stupid: I found out my Facebook was deactivated not deleted so I reactivated it. The first thing that comes up is my SO's mom messaging me from March (a few days before my Nmom called my work), my birthday, and May. All about my Nmom, the last message being a "cute pic" of my deceased Nbrother and I as babies. I told my SO that she doesn't understand by "I don't want anything to do with my family" so he told me after I delete my Facebook he'll tell his mother one more time to stop. One more time. I downloaded my shit and deleted my Facebook completely. Don't go on your old Facebook, kids!
Thank you to everyone again. Someone down below mentioned I should definitely post when I graduate college and I so will! My DMs are open to all.
EDIT 3: For further reading, I found a document entitled Fabricated or Induced Illness by Carers A Practical Guide for Paediatricians. It's a bit old but it is a great read. I'm also going to try and find my pediatrician's records from the hospital he was affiliated with in my home state and request those as well.

Joe Bidens plans for Guns Outlined

THE BIDEN PLAN TO END OUR GUN VIOLENCE EPIDEMIC

Joe Biden knows that gun violence is a public health epidemic. Almost 40,000 people die as a result of firearm injuries every year in the United States, and many more are wounded. Some of these deaths and injuries are the result of mass shootings that make national headlines. Others are the result of daily acts of gun violence or suicides that may not make national headlines, but are just as devastating to the families and communities left behind.
Joe Biden has taken on the National Rifle Association (NRA) on the national stage and won – twice. In 1993, he shepherded through Congress the Brady Handgun Violence Prevention Act, which established the background check system that has since kept more than 3 million firearms out of dangerous hands. In 1994, Biden – along with Senator Dianne Feinstein – secured the passage of 10-year bans on assault weapons and high-capacity magazines. As president, Joe Biden will defeat the NRA again.
Joe Biden also knows how to make progress on reducing gun violence using executive action. After the tragedy at Sandy Hook Elementary School in 2012, President Obama tasked Vice President Biden with developing both legislative proposals and executive actions to make our communities safer. As a result of this effort, the Obama-Biden Administration took more than two dozen actions, including narrowing the so-called “gun show loophole,” increasing the number of records in the background check system, and expanding funding for mental health services.
It’s within our grasp to end our gun violence epidemic and respect the Second Amendment, which is limited. As president, Biden will pursue constitutional, common-sense gun safety policies. Biden will:
Hold gun manufacturers accountable. In 2005, then-Senator Biden voted against the Protection of Lawful Commerce in Arms Act, but gun manufacturers successfully lobbied Congress to secure its passage. This law protects these manufacturers from being held civilly liable for their products – a protection granted to no other industry. Biden will prioritize repealing this protection.
Get weapons of war off our streets. The bans on assault weapons and high-capacity magazines that Biden, along with Senator Feinstein, secured in 1994 reduced the lethality of mass shootings. But, in order to secure the passage of the bans, they had to agree to a 10-year sunset provision and when the time came, the Bush Administration failed to extend them. As president, Biden will:
Keep guns out of dangerous hands. The federal background check system (the National Instant Criminal Background Check System) is one of the best tools we have to prevent gun violence, but it’s only effective when it’s used. Biden will enact universal background check legislation and close other loopholes that allow people who should be prohibited from purchasing firearms from making those purchases. Specifically, he will:
End the online sale of firearms and ammunitions. Biden will enact legislation to prohibit all online sales of firearms, ammunition, kits, and gun parts.
Create an effective program to ensure individuals who become prohibited from possessing firearms relinquish their weapons. Federal law defines categories of individuals who are prohibited from purchasing or possessing firearms, and the federal background check system is an effective tool for ensuring prohibited persons cannot purchase firearms. But we lack any serious tool to ensure that when someone becomes newly prohibited – for example, because they commit a violent crime – they relinquish possession of their firearms. There are some promising models for how this could be enforced. For example, California has a mandatory process for ensuring relinquishment by any individual newly subject to a domestic violence restraining order. As president, Biden will direct the FBI and ATF to outline a model relinquishment process, enact any necessary legislation to ensure relinquishment when individuals newly fall under one of the federal prohibitions, and then provide technical and financial assistance to state and local governments to establish effective relinquishment processes on their own.
Incentivize state “extreme risk” laws. Extreme risk laws, also called “red flag” laws, enable family members or law enforcement officials to temporarily remove an individual’s access to firearms when that individual is in crisis and poses a danger to themselves or others. Biden will incentivize the adoption of these laws by giving states funds to implement them. And, he’ll direct the U.S. Department of Justice to issue best practices and offer technical assistance to states interested in enacting an extreme risk law.
Give states incentives to set up gun licensing programs. Biden will enact legislation to give states and local governments grants to require individuals to obtain a license prior to purchasing a gun.
Adequately fund the background check system. President Obama and Vice President Biden expanded incentives for states to submit records of prohibited persons into the background checks system. As president, Biden will continue to prioritize that funding and ensure that the FBI is adequately funded to accurately and efficiently handle the NICS system.
ADDRESSING THE DEADLY COMBINATION OF GUNS AND DOMESTIC VIOLENCE
The statistics tell a devastating and overwhelming story. The likelihood that a woman in a domestic violence situation will be killed increases by a factor of five if a gun is nearby. Half of mass shootings involve an individual shooting a family member or former intimate partner. This deadly connection tragically impacts children as well: 86% of children killed in shootings with four or more victims were involved in domestic or family violence.
Biden recognizes that the gun violence and domestic violence epidemics are linked and cannot be solved in isolation. Addressing the interconnectedness of these challenges will be a core focus of Biden’s anti-violence work as president.
The Violence Against Women Reauthorization Act of 2019, which Leader McConnell refuses to bring to the floor for a vote, includes a number of reforms to keep firearms out of the hands of abusers. Senator McConnell should ensure this legislation gets passed long before President Biden would take the oath of office. But if McConnell refuses to act, Biden will enact legislation to close the so-called “boyfriend loophole” and “stalking loophole” by prohibiting all individuals convicted of assault, battery, or stalking from purchasing or possessing firearms, regardless of their connection to the victim. This proposal is modeled after existing laws in California, Connecticut, Hawaii, Nevada, New York, and Pennsylvania. Biden also supports enacting the proposal to prohibit anyone under a temporary restraining order from purchasing or possessing a firearm before their hearing.
In addition, President Biden will:
Make sure firearm owners take on the responsibility of ensuring their weapons are used safely.
Empower law enforcement to effectively enforce our gun laws.
TACKLE URBAN GUN VIOLENCE WITH TARGETED, EVIDENCE-BASED COMMUNITY INTERVENTIONS
Daily acts of gun violence in our communities may not make national headlines, but are just as devastating to survivors and victims’ families as gun violence that does make the front page. And, these daily acts of gun violence disproportionately impact communities of color. But there is reason to be optimistic. There are proven strategies for reducing gun violence in urban communities without turning to incarceration. For example, Group Violence Intervention organizes community leaders to work with individuals most likely to commit acts of gun violence, express the community’s demand that the gun violence stop, and connect individuals who may be likely perpetrators with social and economic support services that may deter violent behavior. These types of interventions have reduced homicides by as much as 60%. Hospital-Based Violence Intervention engages young people who have been injured by gun violence while they are still in the hospital, connecting them to social and economic services that may decrease the likelihood they engage in or are victims of gun violence in the future. Biden will create a $900 million, eight-year initiative to fund these and other types of evidence-based interventions in 40 cities across the country – the 20 cities with the highest number of homicides, and 20 cities with the highest number of homicides per capita. This proposal is estimated to save more than 12,000 lives over the eight-year program.
Dedicate the brightest scientific minds to solving the gun violence public health epidemic. In 2013, President Obama issued a memorandum clarifying that a longstanding appropriations rider that prohibited the Centers for Disease Control and Prevention (CDC) and other federal scientific agencies from using federal dollars to “advocate or promote gun control” does not prohibit those agencies from researching the causes and prevention of gun violence. The National Institutes of Health (NIH) subsequently embarked on funding some of this research, though Republican leadership in Congress refused to appropriate any funds to the CDC for this work. Biden will call for Congress to appropriate $50 million to accelerate this research at the CDC and NIH.
Prohibit the use of federal funds to arm or train educators to discharge firearms. We should be passing rational gun laws, not requiring educators who already have too much on their plates to also protect the safety of their students. Biden supports barring states from using federal dollars to arm or train educators to discharge firearms.
Address the epidemic of suicides by firearms. Biden believes any plan to address the gun violence epidemic must address suicides by firearms, which account for 6 in 10 gun-related deaths but are often left out of the conversation. Many of the policies noted above – including safe storage requirements and extreme risk protection orders – will have a serious impact on efforts to reduce gun violence. But there’s so much more we need to do to support people experiencing suicidal ideation. In the months ahead, Biden will put forward a comprehensive plan to improve access to mental health services.
SUPPORTING SURVIVORS OF VIOLENCE AND THEIR COMMUNITIES
Violence causes ripples of trauma throughout our communities, impacting not just the victims of violence but also their communities and first responders. Fear of school shootings is having a noticeable impact on the mental health of Gen Z. Intimate partner violence is linked to depression, post-traumatic stress, and other mental health challenges among survivors. And, this trauma can be intergenerational. Science now shows that young children who witness violence – including in their home – literally alters the parts of their brains that affect “reasoning, planning, and behavioral control.”
We need to reduce violence to prevent trauma from happening in the first place. But we also must treat the resulting trauma as a serious crisis in its own right.
As president, Biden will:

The Drum Major Takes a Stand. Part 2

The Drum Major Takes a Stand. Part 2
DCI Secrets & Stories is back and ready to take on the facts - especially after the outcome of the George Hopkins saga. Since our initial posts have been archived, we are posting again and will then follow-up with Part 3. The link to the original post and discussion is listed at the end of this post.
https://preview.redd.it/ksoi9fc4lwp51.jpg?width=248&format=pjpg&auto=webp&s=2d1cc562aec7d52fc3d6b4d43ab030f1812278ba
The goal of this post is to provide additional information and accepted best practices regarding the DCI Code of Ethics and Compliance, the reporting and investigation process, and alignment with specific participating organizations. The review identified the following as critical thinking questions regarding the success and/or failure factors, which may be apparent.
Critical Questions for Consideration and Discussion:
  1. Has DCI established a specific investigative process or best practices for participating organizations to follow in regards to identifying the proper skills, credentials, training and responsibilities of an investigator?
  2. Has DCI established criteria for required documentation and communication regarding Ethics and Compliance reporting and investigations?
  3. Does DCI provide Certified Compliance & Ethics Professionals (CCEP) to conduct internal investigations, or provide consultation and training for participating organizations? [CCEP designates those with knowledge of relevant regulations and expertise in compliance processes sufficient to assist organizations in understanding and addressing legal obligations, and promote organizational integrity through the operation of effective compliance programs.]
  4. Does DCI provide professional training to participating organizations and their staff to conduct proper investigations regarding reports of misconduct?
  5. Does DCI require a skills assessment of those who could potentially conduct investigations regarding alleged misconduct?
  6. How does DCI address the issue of conflict of interest and bias in regards to all areas of those who could potentially conduct investigations of alleged misconduct?
  7. Does DCI provide training or resources to participating organizations and their staff regarding the laws, which pertain to mandatory reporting, discrimination, harassment and bullying, sexual abuse, and other misconduct, which may require criminal investigation?
  8. What is the intention and purpose for DCI to establish a formal Code of Ethics and Compliance if they have no accountability to enforce them? “While DCI has a broad policy and encourages the participating organizations to have established policies and procedures, ultimately the responsibility lies directly with them.” Dan Acheson, CEO Drum Corps International
The Drum Major
On June 28, 2019, Taylor Smith left the housing site for the DCI Central Indiana show near Muncie, IN and spent the next several hours in conversation with his family. The discussion was deep, thoughtful, and miserable. Based on the information shared with Taylor and his mom – directly from the Corps Director, there were very few options to consider. The next steps were only about doing the “right thing” for Taylor. Very late that night, Taylor notified corps director and the full Blue Star's membership that he would be leaving the tour for the sake of his own personal health and well-being. He then shared a personal message to the corps, telling them how much he loved them, was proud of them, and wishing them well for the remainder of the season. He knew he would not be able to control the narrative from that point forward.
Those next few weeks are somewhat of a blur – life did go on, but nothing was the same at the Smith house. Taylor was grieving; they were all grieving. It was a unanimous vote of support that Taylor should make a formal complaint with DCI. Taylor documented every detail he could; he reviewed his statement several times in order to be as specific and truthful as possible, and then he submitted 15 pages of information to substantiate his allegations to DCI on July 19, 2019.
DCI Code of Conduct & Ethics Guidelines
On May 16. 2018, Drum Corps International’s Board of Directors released the revised and updated comprehensive set of guidelines for all participating organizations in DCI programs and activities regarding the safety and well-being of performers, staff, and volunteers, which set forth DCI’s expectations for its participating organizations, while also recognizing the different state laws applicable in each participating organization’s home state.
An accurate analogy might be that GH was DCI’s Harvey Weinstein, and let the cat out of the bag. However, unethical behavior is not just about sexual misconduct. DCI publicly acknowledged that people around the world and throughout our country face the harsh realities of bias, harassment, and incivility. Misconduct is not new in today’s society or drum corps, but we are becoming more aware than ever before, and we are more likely to listen to accusations concerning allegations of wrongdoing. DCI declared that any behavior that demeans, harasses, or reflects bias against another member of the drum corps community is not acceptable, although even more important is this question, “What can we do to stop it?”
A code of ethics and compliance provides a structure on which to build an organizational culture of respect, trust, accountability and transparency; this also means there is less room for mistakes. A well-written code clarifies an organization’s mission, values and principles, and makes it easy to do the right thing and difficult to do the wrong thing. It is clear that DCI expects all participating organizations to align their ethics and compliance policies and guidelines with those set forth by DCI, which appear to be clearly stated and comprehensive.
The link to the DCI Code of Conduct & Ethics Guidelines provided in the first comment below.
The 18 page DCI Ethics and Compliance document is available online as an image, and may be shared directly to social media or with a link; however, the PDF cannot be downloaded or shared as a document in any manner.
DCI’s policies and guidelines do address topics of who, what, where and when, but clearly there is no structure regarding the “HOW”. DCI states it “seeks to support a welcoming and encouraging environment for individuals to raise reports of misconduct, where individuals are comfortable and protected from retaliation”. What appears to be a critical missing piece of the puzzle is the “HOW” to create that safe environment and the “HOW” to conduct and report investigations of alleged misconduct. Providing an established set of written policies is essential, but it does not ensure members and staff will receive the necessary education and training regarding those policies, and/or the “HOW” to be compliant.
According to DCI’s Policies and Procedures, a report is received by the Ethics & Compliance Committee or Compliance Officer, will be reviewed, and the reporter will be contacted within 5 business days regarding further action. In addition, per DCI policy, the majority of reports made directly to the Ethics Committee will expected to be referred to the participating organization to conduct the actual review, investigation and follow-up. In Taylor’s case, this was the Blue Stars.
Dan Acheson, CEO, Drum Corps International: “Over the past couple of years DCI has worked to refine its confidential process of investigating compliance matters. While DCI has a broad policy and encourages the participating organizations to have established policies and procedures, ultimately the responsibility lies directly with them. However, DCI is always interested in strengthening its policies and procedures.”

The Blue Stars’ statement on Ethics and Compliance is linked in the first comment below.
The full narrative regarding the Blue Star’s Member Code of Conduct does not appear to be published for public review. The full Blue Stars Code of Conduct can found in the member contract provided in the first comment below.
These are the specific reporting guidelines found in the Blue Stars member contract:
Blue Stars Reporting and Designated Responsible Official
“If you believe you have been subjected to sexual harassment or of any other activity that is prohibited by these policies, you are encouraged to approach the person and ask him/her to immediately stop the offensive or prohibited behavior. If you are uncomfortable doing so, then you should report the activity as soon as possible. Depending on the seriousness of the activity or the person(s) involved, you should report to: Section Leader / Drum Major / Corps Director / Executive Director / President of the Board of Directors
Blue Stars is committed to investigating thoroughly, promptly, impartially, and discretely. The facts of each situation will determine the response. Appropriate corrective action, up to and including expulsion from the Blue Stars will be taken if it is determined that a serious violation has occurred.
All information regarding any specific situation will be kept confidential within the necessary boundaries of the investigation.
If you wish to be anonymous, you can submit the report through the whistleblower link on the bluestars.org website.
Reprisals or retaliation against any member reporting violations or participating in any investigation will not be tolerated.”
About Ethics, Compliance, and Investigation
“Ethics and compliance are essentially different sides of the same coin. Compliance is following the law, while ethics is doing what is right regardless of what the law says. Compliance is something that the management requires you to do. Ethics, on the other hand, is something you choose to consider when taking action.” {The Board Effect/ Jan 27, 2014]
If looking at comparisons for definitions of a strong code of conduct, it is safe to assume the Ethics and Compliance parameters for drum corps organizations would likely fall somewhere between higher education and non-for-profit work environments. It is quite easy to review information regarding standard policies of Ethics and Compliance online, and one can quickly confirm DCI’s policies, guidelines and language properly reflect best practices and reinforces good intentions and efforts.
However, when you add the term “investigation”, the wheels appear to fall off the bus regarding participating organization’s related policies and documentation. The absence of a professional investigation process and qualified investigators appears to be a major shortcoming in DCI participating organizations. Every investigation has its own unique issues, circumstances, dimensions, challenges and outcomes; and how an organization manages investigations of potential misconduct can affect their reputation almost as much as the alleged conduct itself. The bottom line is that an investigation can cause serious harm if not conducted properly.
An investigation is, by definition, fact-finding. At the very least, organizations should develop a framework regarding how internal investigations are to be conducted, which includes the methods and means, which are considered appropriate or not. An investigation is responsible for determining, fully and credibly, what happened with respect to a particular incident - whether suspected conduct did or did not take place; what the circumstances were; who was involved, and whether a violation of law or organizational policy occurred.
All reports or complaints, even those that may seem trivial, should be investigated thoroughly. Consistent principles and procedures must be followed whenever allegations of misconduct are reported, and the investigation process should be thorough, independent and analytical. Organizations should treat all those accused of similar wrongful conduct in the same fashion, regardless of the status of the parties involved.
The framework of an investigation is committed to answering two basic questions: what happened (the truth) and why did it happen? The investigative process should result in a clear written determination of the validity of claims based on the credible facts obtained, and the organization should monitor and confirm the fairness of the process prior to release of the results.
Best practices regarding the investigative process regarding misconduct includes four basic components:
  • Thoroughly documenting incidents of actual or suspected misconduct in order to maintain a permanent record of their occurrence,
  • Identifying the root cause of an incident where the improper conduct occurred,
  • Identifying people involved in misconduct, and
  • Compiling information that proves or disproves an allegation or that implicates or exonerate the person suspected of misconduct. This is especially true if the outcome of the investigation is used to justify disciplinary or other post-investigation action.

There is a well-known rule of thumb in educational, business and healthcare environments, “If it’s not written down – it didn’t happen.” regarding the critical importance of timely and accurate documentation. Those involved in the investigation process should compile and maintain a thorough file on the reported allegation and process. The file should include:
  • A copy of the original complaint.
  • Detailed notes of each interview.
  • The name of each witness, whether that person was interviewed, and if not, why not.
  • The notes or documents provided by any participant in the investigation.
  • A final report summarizing findings and conclusions.
  • Planned follow-up and monitoring.
Qualified Investigators
Choosing the right person to conduct an investigation of alleged organizational misconduct is quite complicated. According HR law firms, scholarly articles and publications from SHRM [Society for Human Resource Management] on the topic ethics and compliance, an investigator’s only agenda should be a competent, fair process and result. The proper investigator should have the professional competence, necessary skills, knowledge and experience to conduct the investigation, but must also be without bias, conflicts of interest, and have no personal stake in the parties or the outcome. An investigator has the obligation to review all credible information as objectively as reasonably possible, and it is important to take all of these requirements into account to ensure the investigation is fair, objective and can stand up to scrutiny.
The obvious issue is that very few people are trained investigators outside the world of human resources, law enforcement, and social services; even more so if a situation involves a potential victim. The skills, techniques, and goals of standard HR interviewing and those of Ethics and Compliance investigations are very different and require specific and extensive professional training.
After careful review of the information available regarding the investigative process and those who may potentially conduct the investigations of alleged misconduct within the DCI Code of Ethics and Compliance, there is no evidence of an established framework or clear guidelines for participating organizations to follow.
Based on this review, it appears there is tremendous room for improvement in defining and creating the “HOW” in regards to DCI’s Ethics and Compliance polices. A positive start would be to provide and/or mandate training regarding the investigative process and required investigator skills. If DCI is truly committed to member safety and creating a culture of respect, trust, accountability and transparency, then further education and training in the following areas is appropriate:
\* Trauma Awareness / Emotional Wellness / Americans with Disabilities Act (ADA) / Practical Ethics When Working With Victims / Professional Competence / Risk Factors for Harassment / Abusive Conduct and Bullying / Bystander Intervention / Conscious and Unconscious Bias / Protected Characteristics / Hostile Work Environment / Civility ***
Coming up in the next segment of ‘A Drum Major Takes a Stand’ will be the details regarding Taylor’s own experience with DCI’s reporting and investigative process. However, the spoiler alert is the process did not align with recommended “best practices” outlined above, or the ethical requirements for a trained investigator.
Maybe the ultimate question to consider is...
Is it possible for participating drum corps organizations within the established culture, to abide by best practices guidelines in order to provide a fair, unbiased, credible internal investigation regarding alleged misconduct?

Exploring the benefits of dating a tall man, and why it’s hard to argue against hypergamy

Some people say that the obsession woman have with high genetic quality in their make partners is “shallow”. I don’t think this is the case. And that’s the problem. It’s really hard to argue against hypergamy.
Let me use height as an example, as it’s easy to quantify. As we all know being tall has many social advantages. Let me give a few examples.
This study links male height and relationship satisfaction for the male.
https://journals.sagepub.com/doi/10.1177/147470490900700310?icid=int.sj-related-articles.similar-articles.45&#articleCitationDownloadContainer
Quote: “It was found that the taller men generally reported greater satisfaction with their romantic relationships. The researchers stated that the cause of this relationship was possibly because their partners were more attentive and warm towards them then the shorter men's, and that the taller men were also potentially more likely to be partnered with more desirable women.”
This article discusses a study that links tall height to better salaries.
https://www.theguardian.com/money/shortcuts/2015/ap29/do-tall-people-really-deserve-to-earn-more
This study links tall height to all manner of advantages.
https://www.jstor.org/stable/43421008?seq=1
Quote: “Taller people are more likely to be better educated; in employment and employed in higher status occupations; married; and to live in better housing in more prosperous areas of the country. Taller people are also more likely to move within and between countries and to be upwardly socially mobile. Taller people have lower age-standardized death rates than shorter people.”
So, if you go for a tall partner, they are more likely to have many of these desirable qualities.
And obviously, many of these traits could be passed on to your children. In fact, there are even more reasons why you would want tall children.
This article discusses a study which found that shorter children are more likely to be bullied.
https://www.eurekalert.org/pub_releases/2000-03/BMJ-Scml-0203100.php
Quote: “More short pupils claimed to have been bullied at some point in secondary school. Short boys were twice as likely as their taller peers to say that they had been the victims of bullying, and much more likely to say that bullying upset them. Significantly more of the short children said that bullying had started in junior school and that they were still being bullied.”
This article discusses two studies that suggest that bullies are more likely to find social success.
https://www.dailymail.co.uk/news/article-3177486/Child-bullies-sexier-popular-dates-victims-grow-new-research-suggests.html
Quote: “Bullies have more sex appeal and a higher social standing than everyone else, research has found.
Child bullies are well adjusted people who are coldly calculating and intimidate others because it makes them more popular.
Later in life they have more dates and more sex than the rest of their former classmates, the study showed.”
Am I suggesting that you would prefer it if your child was a bully, rather than a victim?
Yes.
Let’s continue. Many sports are easier to compete in if you’re tall. Keep in mind that about 15% of men are >6’ (a quick google search will confirm this).
The average height of a professional baseball player is 6’1”.
Football/soccer: 6’
Swimming: 6’4”
Heavy weight boxing: 6’4”
Basketball: 6’7”
Additionally, the minimum height for a male model is generally 5’11”.
So your son has a better chance of acquiring all of these desirable jobs.
But here is perhaps the most intriguing aspect of having tall sons.
This study correlates short stature with a higher chance of suicide among males.
https://ajp.psychiatryonline.org/doi/pdf/10.1176/appi.ajp.162.7.1373
(Keep in mind this study was carried out in Sweden, where the average height is about 5’11”)
Now I’m not suggesting that women are aware of these studies (I’m sure they’re not, apart from perhaps the statistic on tall height and salaries). But throughout people’s lives, they will subconsciously notice that the most dominant figures in the institutions they participate in will most likely be tall. They will see shorter male peers struggle (and reject them themselves).
They will also be influenced by media which depicts heroic, masculine figures as tall. Take the actors of the heroes in the Marvel Cinematic Universe as an example:
Chris Hemsworth: 6’3”
Chris Evans: 6’
Chris Pratt: 6’2.5”
Robert Downey Jr. is only 5’8”, but he will wear elevator shoes to appear close to the heights of his cohorts if they are in the same scene. Here’s a funny one: Wolverine is apparently 5’3” in the comics, but in the films he is depicted by Hugh Jackman, who is 6’2.5”.
(Keep in mind that agencies will often add an inch or two of height to an actors resume, and of course men themselves are known for inflating their true heights. Some of these will be inaccurate)
So, can anyone actually give me a convincing argument as to why women should not reproduce with only tall men?
Shorter children require less food and you do not have to buy as many new sets of clothes. Fantastic.

The Official r/Mitski Black Lives Matter Resource Masterpost!

Hello, losing dogs! Tonight, I wanted to use this platform to spread resources and information pertaining to the ongoing protests against police brutality. While we are a mere fan sub, Black Lives Matter is not up for debate here or anywhere else, and I want to make sure that everyone here is informed and, if they’re headed to protests, staying safe. The Mitski fandom is diverse and varied in its composition, and it is in all of our best interest to support each other and fight for equality. As such, this post will serve as a kind of master list of resources that you can use to educate yourself, take action, and keep protected against the violence police have been inflicting at protests. Y’all matter to me, and I want to make sure that you don’t get hurt. Without further ado, I present this list:
Masterdocs
Petitions To Sign
Trigger warning: these petitions discuss very violent and upsetting cases. You don’t have to read through each one - it helps to inform yourself, but don’t overload yourself. Your mental health matters. DO NOT DONATE to change.org when it asks you to - your money is going to change.org, NOT the cause you signed about.
Calling, Texting, and Emailing
Donate!
Note: these are important organizations even while protests aren’t going on, and they could use your continued support.
Social Media
Protest Safety
So you’re going to a physical protest. That’s an amazing step, good on you! Remember, no matter how peaceful your local protest is, there is a real risk of facing arrest or brutality. If you’re going out, remember the following things:
Educate Yourself
Black Musicians
Since we are a music sub, I thought I’d share some of my favorite underappreciated Black bands and artists: Kilo Kish, MorMor, Kodie Shane, The Txlips Band, Shea Diamond, Pleasure Venom, Tobi Lou, Nyota Parker, Thundercat, Davia Spain, Tierra Whack, Laura Mvula, and Big Joanie. (Speedy Ortiz and Barrie also each have a Black member, but are mostly white.) Please recommend some more down in the comments, and support them by downloading and streaming their works!
Of course, this list is not exhaustive, and if you have any more resources you want me to add to the post, just comment them and I’ll add them on! I hope everyone’s staying safe and being good to each other. I love all of you and I want to create the most supportive environment I can. Remember, if you’re experiencing harassment on the sub, you can always reach out to u/TotallyNeurotypical or myself, and we will shut that down ASAP. Wishing you all the best, let’s push for change together!

How to Sell Workout Plans Online: 4 Steps to Starting an Online Personal Training Business

How to Sell Workout Plans Online: 4 Steps to Starting an Online Personal Training Business
We all want to feel fit and healthy, but we often need some extra direction.
Between busy schedules, feelings of inadequacy next to bodybuilders at the gym, and generally struggling to make space for a new health journey, many people are looking for extra direction when it comes to fitness.
Getting started, staying motivated, and working toward more difficult fitness goals are all hard, which is where personal trainers come in. Good news: the internet has made it easier than ever to sell services online and get the word out about your product.
Ready to sell workout plans online? You’ve come to the right place. Read on for four steps to get you started today.
4 Steps to Sell Workout Plans Online
1. Build a Following 2. Create and Sell Workout Plans Online 3. Market Yourself 4. Continue To Grow
This article will help you find the best way to start an online personal training business; or if you already sell workout plans online, how to increase your sales and grow your business.
1. Build a Following
Most people can’t just pop up on the fitness scene and expect customers to start buying from you.
They don’t know you, especially if you are competing with a celebrity or a popular fitness guru, so spend time building up a persona and audience through social media and blogging.
Detail how you workout day to day, show what your motivations are, and show how easy it would be for people to incorporate your online workout plan into their daily lives.
Start with social media: use Instagram and another picture-dominated social media platform to promote yourself. Have a daily post or a few of them on each of these platforms.
A great idea to get content out there each day is to have a theme for the day and a workout plan to go with it.
For example, have “Motivation Mondays,” or “Workout Wednesdays”. Include a segment of a workout that helps you (and your customer) towards that goal. Think about what will connect with your target base.
Another good theme for the day is a “Cheat Day” because everyone connects to slacking off a bit! Show how you beat your cheat day by doing a workout plan during a movie, or exercises that can be done from a couch.
Working out is difficult, sweaty, and often involves some personal discomfort. Your photos should show the reality.
That doesn’t mean you can’t also make it fun and slightly glamorous- you’re still pitching a road to a better quality of life.
When your following groans and empathizes with the struggle, start pitching your personal training services in your posts. This is a great way to direct targeted traffic to your site where you sell workout plans online.
2. Create and Sell Workout Plans Online
Alright, now it’s time to build your website to sell workout plans online You will need your own website to showcase your workout plans and videos, to detail your healthy, fit lifestyle, and to sell your products!
Use an ecommerce platform to showcase your healthy lifestyle and sell workout plans online at the same time. Make sure to add a blog to your online store so you can build your credibility and authority to potential customers.
Here are some things to add to your website:
Workout plan teasers
Show snippets of your workout plans on your website to entice people to buy.
Before and after pictures
Ask customers to submit their progress in photos or videos to display on your site. If you’re going to sell workout plans online, you want to show potential buyers that they work!
The workout plans
Make sure to have a simple buying process for your customers. If you’re wondering what format to sell workout plans online, typically creating digital downloads (like eBooks) is a great way to immediately deliver your products.
Make sure your store has great product images and descriptions that entice people to buy. Ensure you test your checkout process so you know when someone hits the coveted “buy” button, they are getting their plan immediately.
What the plans include
By showing potential buyers what the whole program will look like for them, without giving away the entire thing, customers will be comforted by knowing exactly what they are purchasing.
That way, no one is upset with the purchase, so your feedback is going to be positive and supportive, which will build your credibility and increase your customer base.
Equipment needed
Make sure to clearly state what equipment your clients will need to do their workouts! This is a great way to make sure you’re selling the right plans to the right clients.
Here’s a great example of a plan-list page from SuzieBFitness:
Reviews from happy fitness clients
Show evidence of you supporting and training your customers into their successful fitness stories.
Testimonials help to emphasize your role in your customer’s transformations. They’re a great way to turn an interested consumer into a paying customer.
Your personality
The first thing anyone looking to buy your workout plans online is going to want to see is your results, but you need to show them the journey it took to get there.
For one thing, they will want to see how fit you personally are. This matters in a “practice what you preach” sort of way, but potential customers will also want to see how other people who already invested in your training are doing.
Videos
Another aspect of your website should be videos. People can usually follow a workout plan made up of pictographs of the exercises used in your workouts, but videos where your customers can actually see the motions are much easier to follow.
Use YouTube to showcase your workout plans, showing how supportive your personal training is to your customers, and how fast their fitness results are with your online workout plan.
Blog
I mentioned this before, but adding a blog to your online store is a great way to bring in new customers (and help your current clients).
Your blog should have some information on healthy eating and general practices you do to stay fit. Have a list of motivational quotes or a link to some great healthy eating recipes. If you are going to sell workout plans online, it’s great to include snippets of the lifestyle you follow.
Again, connections to your customers and to potential customers will really help sell workout plans online. Continue to grow and increase the number of workout plans you offer to keep your current customers growing with you!
3. Market Yourself
Wait, isn’t social media my marketing strategy here? Yes, to a large extent social media is really the best way to connect with people as you start to sell workout plans online.
However, you do need to increase your coverage to get more customers, so having a marketing strategy never hurts!
Most people looking to purchase workout plans online are looking for professional help, without the cost of hiring an in-person trainer.
These people also probably want to target something specific, such as weight loss, gaining muscle, or simply feeling more confident. Finding a niche to sell your workout plans online is key to getting finding more customers.
A good way to increase personal training sales by offering season-specific workout plans for these types of people, or you can target a specific area and work with that.
📷
You need to differentiate each workout plan by making sure you have different before and after pictures, and different targeting strategies for each.
Once each plan is set up and ready to go, repeating the sequence each year after that with something slightly new or different workout plans or goals should be simple.
Starting is going to be the hardest part, but having a large database of workout plans will only keep customers coming back for more!
As you start promoting your workout plans and online personal training business, remember to keep your audience in mind.
People looking for training help may be insecure, worried, or simply lost in the world of fitness. Don’t bully these people: offer a solution!
If people are feeling insecure about being out of shape, give them an easy startup and walk them through it gently. No one wants to feel insecure about his or her fitness level, so make sure you sell workout plans online that will fit their needs.
If you’re going to sell workout plans online, it’s important to offer additional assistance to your clients. Allow your clients to contact you personally with questions or concerns.
Go above the plan and offer nutrition assistance to people who need it. People are more inclined to purchase your workout plans if they feel they are receiving something more than a PDF download!
4. Continue To Grow
If you’re going to sell workout plans online, increasing personal training sales can be done if you become an authority for a specific niche.
Could you become the #1 virtual trainer for pregnant women? What about busy moms with no time to go to the gym? Use some of the marketing strategies listed above to get started, but don’t stop once you have one online workout plan completed.
The key to continued success and increased online personal training sales is to keep evolving your products.
Offer different levels or tiers of training, so customers will have new and exciting levels of fitness to achieve. This will keep them coming back for more.
The best part about this level or tiering system is that once you get each level completed, it becomes passive income. Beginner online fitness customers are going to start your program at the first level, which you already have set up and ready to go.
Of course, you still have to be available for personal assistance, but the workout plan is set and passively generating income for you.
Continuing to grow also gives you credibility to attract new customers and grow your online business even further.
All it takes for a personal trainer to start an online business is to build up some great workouts, develop a social media presence, create a website with your workout plans, and start collecting a profit!
Like it? Share it.
